1. Use of Services

You must be at least 18 years old to use our Services. By using OrbitAI Labs, you confirm that you meet this requirement and have the legal capacity to enter into this agreement.

2. Software Licensing

All trading bots and software products are licensed, not sold. You are granted a non-exclusive, non-transferable, revocable license to use them, subject to compliance with these Terms.

• No redistribution, resale, or reverse engineering is allowed.
• Licenses are limited to specific users or devices.
• We may revoke licenses in case of misuse.

3. Subscriptions and Payments

By purchasing a license or subscription, you authorize us to charge your payment method on a recurring or one-time basis, as chosen.

• Prices may change with prior notice.
• You may cancel anytime via your dashboard.
• No partial refunds unless required by law.

4. Refund Policy

We offer a 48-hour refund window for first-time purchases if the software has not been activated or downloaded (activation includes logging in or initiating any software functionality). After this, all sales are final. To request a refund, submit a written request to support@orbitailabs.com within 48 hours of purchase. Contact support@orbitailabs.com for help.

5. No Financial Advice

OrbitAI Labs provides automated tools but does not offer financial or investment advice. Use at your own risk and consult a licensed advisor before making trading decisions.

6. Risk Disclaimer

Trading involves substantial risk. Past results do not guarantee future performance. We are not responsible for any losses incurred, including those related to tax implications or regulatory changes in your jurisdiction.

7. Intellectual Property

All content, software, visuals, and branding are property of OrbitAI Labs and protected under intellectual property laws.

8. Termination

We may suspend or terminate access to our services at any time for violation of these Terms or other harmful activity.

9. Changes to Terms

These Terms may be updated periodically. We will notify you of significant changes via email or a notice on our website at least 30 days in advance. Continued use of our services after changes constitutes acceptance of the new Terms.

10. Data Privacy

We collect, store, and process your personal information in accordance with our Privacy Policy, accessible at https://www.orbitailabs.com/privacy-policy. By using our Services, you consent to such processing and agree to provide accurate information. We implement reasonable security measures to protect your data but cannot guarantee absolute security. In the event of a data breach, we will notify you as required by applicable laws.

11. Limitation of Liability

To the fullest extent permitted by law, OrbitAI Labs, its affiliates, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of our Services. Our total liability shall not exceed the amount paid by you for the Services in the preceding 12 months.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Serbia. Any disputes arising from these Terms or your use of our Services shall be resolved through binding arbitration in Belgrade, Serbia, in accordance with the rules of the Belgrade Arbitration Center. You waive the right to participate in class-action lawsuits.

13. User Conduct

You agree not to:

• Use the Services for any illegal or unauthorized purpose.
• Attempt to gain unauthorized access to our systems or networks.
• Share, distribute, or sublicense our software without permission.
• Use the Services to harm or interfere with others, including through malicious code or denial-of-service attacks.

Violation of these rules may result in immediate termination of your account and legal action.

14. Third-Party Services

Our Services may integrate with or rely on third-party platforms, such as trading exchanges or payment processors. We are not responsible for the availability, accuracy, or terms of service of these third parties. You are responsible for reviewing and complying with their terms. Risks include potential downtime, API changes, or other issues beyond our control.

15. Service Availability

We strive to ensure our Services are available but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Services at our discretion, with or without notice, and without liability. We will endeavor to notify you of significant changes in advance.

16. Force Majeure

OrbitAI Labs shall not be liable for any failure to perform our obligations due to events beyond our reasonable control, including but not limited to natural disasters, cyberattacks, or government regulations.

17. International Use

Our Services are controlled from Serbia. By using our Services, you confirm that your use complies with all applicable local laws and regulations. We make no representation that our Services are appropriate or available in all jurisdictions. You are responsible for ensuring compliance with export control laws and any restrictions on automated trading or related activities in your country.

18. Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately at support@orbitailabs.com if you suspect unauthorized access. We recommend using strong passwords and enabling two-factor authentication where available.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will remain in full force and effect.

20. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and OrbitAI Labs regarding the use of our Services, superseding any prior agreements.
